Divorce & Separation

When one party no longer wishes to be married to the other, parties generally separate, unless they can work out their issues through marriage counseling.

Following separation, the parties may settle issues via a Separation Agreement (see more information below) or proceed to Court. Generally parties must wait for 1 year before proceeding with their divorce (unless a party is alleging adultery or cruelty).

Separation Agreements & Marriage Contracts

Kania Buttigieg Professional Corporation is well-equipped to negotiate, draft and finalize contracts that are entered into prior to a marriage; and following the separation of the parties. These contracts are usually between 20-30 pages in length; and set out the terms and conditions that the parties have agreed to set their affairs in order. Child & Spousal Support

Both parents have a financial responsibility to support their children. In addition, one spouse may have an obligation to support the other spouse; depending upon a variety of factors including the roles adopted in the marriage; the disparity in incomes between the parties; and the ability of each party to support him/herself. Custody & Access

This area involves who will make decisions on behalf of the child(ren), and how much time each parent spends with the child(ren). When making decisions pertaining to child(ren), the test is always that of the "best interests of the child". There are a variety of options that may be achieved with the assistance of counsel.

Property

Under the law, marriage is an equal partnership. The general rule is that any property (or debt) acquired during the marriage is split 50/50. This process is known as equalization. If you are unmarried or in a common law relationship different rules and tests apply to the division of property.
